Power of Attorney

What Is It?

A Power of Attorney is a legal document which allows an individual or company to appoint another person to make decisions about your financial property and manage your financial affairs. In essence, this document gives another individual power to act in your name.  It is important to note that even when you sign a Power of Attorney, you still retain all rights and powers to act on your own behalf to manage your financial affairs and carry out any transactions while you are able to do so.  

Why Is It Necessary?

A Power of Attorney can be very narrow and specific, or very broad and general.  It is necessary for individuals to consider making a Power of Attorney so there is an individual who can buy, sell, transfer, or lease property in the case that you or your loved ones become incapacitated.

Enduring Guardianship

What Is It?

An Enduring Guardianship is a legal document that allows you to appoint another person to make decisions on your behalf regarding your medical, health and lifestyle decisions when you lose mental capacity.  

Why Is It Necessary?

If a person loses mental capacity and is no longer able to make medical, health or lifestyle decisions, decisions are still made by family or carers. This arrangement may work well; however appointing a guardian will give certainty regarding the person who makes decisions for you. You may also have specific wishes and want to ensure that your wishes are known and followed.
